Introduction

Welcome to Belvista Software's ("Belvista") Go Star service ("Service") for managing and automating Google review requests. By using our services, you agree to these terms and conditions.

Service Description

The service includes:

  • Automated review solicitation tools

  • Review management dashboard

  • Customizable review request templates

  • Analytics and reporting features

 

Account Registration

Customers must provide accurate account information, including:

  • Company name and address

  • Main contact person details

  • Billing information

You are responsible for maintaining the confidentiality of your account information and for all activities under your account.

 

Term and Termination

  • Month to month term, renewing automatically on the 1st of each month

    • No credit for partial months is provided.

  • We reserve the right to terminate or suspend your account for violations of these terms.

 

Use of the Service

  • Service use limited to soliciting genuine reviews for your company from consumers.

  • You must comply with all applicable laws and platform-specific guidelines for review solicitation.

  • Prohibited activities include soliciting fake reviews or offering incentives for reviews.

 

Customer Responsibilities

Customers are responsible for:

  • Ensuring compliance with platform policies (e.g., Google, Yelp).

  • Providing and maintaining accurate consumer contact information.

  • If Customer responds to consumer reviews, all responses must be done professionally.

  • Respecting consumer privacy and preferences regarding review requests.

 

Review Content

  • Belvista does not create, edit, or manipulate review content.

  • You are solely responsible for the content of reviews solicited through our service, and for any inadvertent third party solicitation due to incorrect information provided to Belvista.

 

Privacy and Data Protection

Belvista may collect and use information as described in our Privacy Policy. You consent to our data practices as described therein.

 

Support

  • Belvista offers email support during business hours and will promptly respond to Customer requests at support@gostarreview.com.

 

Fees and Payment

  • Fees based on the rates as provided to you in the Agreement.

  • Payment due monthly in advance.

  • Late payments subject to late fees and potentially suspension of the service.

 

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES. We do not guarantee any specific outcomes regarding review quantity or quality. Solicitations will be sent to the contact information provided by Customer and we do not guarantee that solicitation attempts will be made to actual consumers of your company.

 

Limitation of Liability

Belvista's liability is limited to fees paid in the 3 months preceding the claim. IN NO EVENT SHALL BELVISTA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

 

Indemnification

Customers agree to indemnify Belvista against claims arising from their use of the Service or violation of these terms including claims from third parties resulting from Customer providing inaccurate or out of date information to contact individuals.

 

Changes to Service

We may modify the Service features with 30 days' notice. Significant reductions in functionality may allow for early termination without penalty.

Dispute Resolution

Disputes will be resolved through arbitration in Monroe County, New York. Any dispute must be filed within one year after the relevant claim arises.

 

Governing Law

The Agreement and Terms of Service are governed by the laws of New York, without regard to its conflict of law provisions.

 

Miscellaneous

  • These terms constitute the entire agreement between Parties.

  • If any provision is found unenforceable, the remaining provisions will continue in full force and effect.

  • Failure to enforce any right or provision doesn't constitute a waiver.

By using the Service, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. Belvista reserves the right to update these terms, with notice provided to Customers.
